CONCERNING:
Control of Operations Breeding Appendix-I Species in Captivity
1. This Notification provides information on captive-breeding operations in Germany, Madagascar and Mexico, and recapitulates the information given in Notifications to the Parties Nos. 754 of 14 June 1993, 769 of 31 August 1993, 792 of 10 March 1994, 825 of 25 August 1994, 857 of 18 April 1995 and 879 of 31 August 1995. These Notifications are, therefore, cancelled.
2. Through Resolution Conf. 4.15 (Gaborone, 1983), the Conference of the Parties requested the Secretariat to compile and update a register of the operations which breed specimens of species included in Appendix I in captivity for commercial purposes, which are entitled to the exemption provided by Article VII, paragraph 4, of the Convention (i.e. those specimens are considered as specimens of Appendix-II species).
3. At its eighth meeting (Kyoto, 1992), the Conference of the Parties adopted Resolution Conf. 8.15 to establish Guidelines for a Procedure to Register and Monitor Operations Breeding Appendix-I Animal Species for Commercial Purposes. This Resolution repealed Resolution Conf. 4.15 and set new conditions for such operations to be registered. In particular, only the operations producing specimens bred in captivity in accordance with the definition of this term provided by Resolution Conf. 2.12 (San José, 1979) may be entered in the Register.
4. The attached "Register of Operations which Breed Specimens of Species Included in Appendix I in Captivity for Commercial Purposes" includes all the operations registered to date by the Secretariat. The Register also includes operations which breed specimens of species the population of which in the country where the operation is located has been transferred from Appendix I to Appendix II subject to export quotas in accordance with Resolution Conf. 7.14 (Lausanne, 1989), although that Resolution has been repealed by Resolution Conf. 9.24 (Fort Lauderdale, 1994).
5. The data provided in the Register are in general those received with the application for inclusion. They are therefore not up-to-date.
6. Parties which desire that operations that occur in their territories and meet the requirements of the Convention and Resolution Conf. 8.15 be entered in the Register are invited to provide the Secretariat with information about those operations as described in that Resolution, in particular its Annexes 1 and 2.
7. Parties on the territories of which no such operations occur or which do not desire to have operations entered on the Register are urged to inform the Secretariat to this effect.
8. This Notification and the Register do not concern operations or persons which occasionally breed specimens of Appendix-I species in captivity, even if they sell them, such as zoos and similar institutions, hobbyists, etc. Specimens produced by such operations and persons, if they meet the definition of Resolution Conf. 2.12 (Rev.), may be entitled to the exemption provided by Article VII, paragraph 5, of the Convention.
9. In accordance with Resolution Conf. 8.15 Annex 4, only the specimens of species included in Appendix I that originate from an operation duly registered by the Secretariat may be traded in accordance with the special provisions provided by Article VII, paragraph 4, of the Convention. Any document granted pursuant to these special provisions for specimens originating from operations which are not listed in the Register should be rejected. In addition, the document should describe the specific identifying marks applied to each specimen. Please refer also to Notification to the Parties No. 913 of 24 April 1996.
10. As explained in the Note at the end of Notification to the Parties No. 904 of 28 February 1996 concerning the Control of Operations Artificially Propagating Specimens of Appendix-I Species, a registration number has been attributed to each operation registered in the attached Register. In accordance with paragraph o) of Annex 1 to Resolution Conf. 9.3 on Permits and Certificates, CITES permits and certificates should include "the registration number of the operation, attributed by the Secretariat, when the permit involves specimens of a species included in Appendix I that originate from an operation practising breeding in captivity or artificial propagation for commercial purposes (Article VII, paragraph 4, of the Convention), and the name of the operation when it is not the exporter".
