Notification to the Parties

CONCERNING:

Proposals to amend Appendices I and II at
the 11th meeting of the Conference of the Parties

1. Article XV, paragraph 1 (a), of the Convention requires that proposals to amend Appendices I and II be communicated to the Secretariat at least 150 days before the next meeting of the Conference of the Parties. The deadline for the submission of such proposals for consideration at the 11th meeting of the Conference of the Parties was 12 November 1999.

2. A list of the proposals received by this date is annexed to this Notification.

3. To ensure that the Parties are able to examine these proposals with the minimum of delay, copies of the supporting statements are being sent to Management Authorities with this Notification, in the language in which they were received by the Secretariat.

4. Electronic versions of these proposals can be downloaded from the CITES Web site (http://www.cites.org) from 30 November 1999.

5. Translations into the other working languages will be available on the CITES Web site as soon as they are available.

6. To Parties that are receiving proposals in a language other than the one they usually use in CITES, printed copies of the translated proposals will be sent as soon as they are available.

CONSIDERATION OF PROPOSALS FOR AMENDMENT OF APPENDICES I AND II

1. In accordance with the provisions of sub-paragraph a) of paragraph 1 of Article XV of the Convention, any Party may propose an amendment to Appendix I or II for consideration at the next meeting of the Conference of the Parties. Any proposal for amendment shall be communicated to the Secretariat at least 150 days before the meeting of the Conference.

2. By 12 November 1999, i.e. 150 days before the opening date of the 11th meeting of the Conference of the Parties, 25 Parties had communicated to the Secretariat their proposals for amendment of Appendices I and II, for consideration at the 11th meeting. These were Argentina, Australia, Bolivia, Botswana, Chile, China, Cuba, France, Georgia, Germany, India, Japan, Kenya, Mexico, Namibia, Nepal, the Netherlands, Norway, the Russian Federation, South Africa, Switzerland, the United Kingdom, the United Republic of Tanzania, the United States of America and Zimbabwe. Most of the proposals were accompanied by supporting statements presented in accordance with provisions of Decision 10.15 and in the format recommended by the Conference of the Parties (Annex 6 of Resolution Conf. 9.24, adopted at the ninth meeting, Fort Lauderdale, 1994).

3. The proposals are divided into the following three categories and the supporting statements are in the documents specified in the Annex:

a) proposals resulting from the periodic review by the Plants Committee;

b) proposals concerning export quotas for specimens of species in Appendix I or II; and

c) other proposals.

4. No proposals were received pursuant to the Resolution on Ranching and no proposals resulted from the periodic review of the appendices by the Animals Committee.

5. The list of all these proposals for amendments is in the Annex to this document.

6. The "proposals resulting from the periodic review by the Plants Committee" and the "other proposals" are listed in the same taxonomic and alphabetical order as that followed for the establishment of Appendices I and II of the Convention. The names of the proposing Parties are given between brackets.

7. The supporting statements for all the proposals are numbered Prop. 11.1, Prop. 11.2, etc., following the sequence in the Annex to this document.

To ensure that where a) destinations for live animals are to "be appropriate and acceptable" and/or b) the purpose of the import is to be "non-commercial", export permits and re-export certificates may be issued only after the issuing Management Authority has received, from the Management Authority of the State of import, a certification to the effect that:

 

 

 

in case a), in analogy to Article III, paragraph 3(b) of the Convention, the holding facility has been reviewed by the competent Scientific Authority, and the proposed recipient has been found to be suitably equipped to house and care for the animals; and/or
